Platform use
Kempian supports sourcing, matching, outreach, evaluation, scheduling, and workforce operations.
Permitted use
Customers may use Kempian for workforce workflows, AI Confidence, human-reviewed candidate review, and approved integrations.

Do not use the platform for fully automated employment decisions, unlawful outreach, unauthorized scraping, or reverse engineering.
Data and privacy
Customer data remains subject to the Privacy Policy and tenant isolation architecture.
Compliance responsibility
Customers remain responsible for employment law, data processing, equal opportunity, and jurisdiction-specific obligations.
Billing
Paid plans are billed according to the selected subscription terms.

1. Acceptance of terms
By accessing or using the Kempian AI platform at app.kempian.ai or kempian.ai, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.
2. Platform description
Kempian AI provides an AI-driven, end-to-end workforce intelligence and management platform. The platform includes AI-assisted candidate sourcing, matching, outreach, evaluation, scheduling, and workforce operations. All AI outputs are decision support tools subject to mandatory human review - they do not constitute automated employment decisions.
3. Permitted use
You may use Kempian to manage workforce demand and hiring workflows, source and evaluate candidates with AI Confidence tools and human oversight, conduct candidate outreach in compliance with CAN-SPAM, GDPR, and CASL, and integrate with approved VMS, ATS, and payroll providers.
4. Prohibited use
You may not use the platform to make fully automated employment decisions without human review, use AI Confidence scores as the sole basis for rejection or selection without documented review, share credentials with unauthorized parties, reverse-engineer AI scoring logic, or contact candidates in violation of applicable opt-out laws.
5. Data and privacy
Your use is subject to our Privacy Policy. Tenant data is isolated per our multi-tenant architecture. You retain ownership of your workforce and candidate data. Kempian does not use your data to train the shared AI model.
6. AI and employment law compliance
Kempian provides AI tools to support workforce decisions. You are responsible for ensuring your use complies with applicable employment laws governing automated decision-making, data processing, and equal opportunity in your jurisdiction. Kempian does not provide legal advice.
7. Subscription and billing
Paid plans are billed monthly or annually as agreed at signup. Plans auto-renew unless cancelled. Contact billing@kempian.ai for billing enquiries.
8. Limitation of liability
Kempian AI is decision-support software. We are not liable for employment decisions made using the platform. Our liability is limited to fees paid in the 12 months preceding any claim.
